FAQ ]Posted by Renee Gaines on 3/4/2003 from 216.117.218.35:In reply to: Workplace Change After Diagnosis posted by Diana on 2/25/2003 from 65.125.48.30:
Dear Diana,
Stories like this always make me sad and angry. Discrimination of any kind in the workplace is not allowed. Seek the advice of an employment attorney, if you can.
Here is the website link for the American with Disabilities Act. http://www.usdoj.gov/crt/ada/cguide.htm#anchor62335. You can download the entire manual and have it for your reference.
No future employer can discriminate about a cancer diagnosis either. You do not need to ever reveal your health history to anyone prior to employment. It is against Federal law to ask any employee about health history for employment. The only jobs that might have that are law enforcement, fire departments or airline pilots. But then a basic physical might be required. Drug testing is the only other legal test that can be asked of for employees.
As far as your boss, try to speak with him. Do not do this alone; ask for a third party to be present. Perhaps someone from Human Resources or his boss if he has one.
If you do get 'released' from this job. Please seek legal counsel, it might be the best thing you could do for yourself.
I'll be thinking of you.
